What Happened
After the verdict of 22.07.2024 Bagrash filed an appeal. Defence counsel RA RΓΆmer submitted the grounds of appeal to the BGH on 28.11.2024. Bagrash had no contact with his counsel and did not know what he had submitted.
Bagrash therefore submitted 8 supplementary grounds of his own between January and May 2025. Their acceptance was systematically blocked by detention facility staff and court clerks β on direct instructions from management.
Key violation: The BGH on 07.05.2025 dismissed the appeal by a formulaic ruling β without substantively examining a single legal argument. The BGH did not respond to any urgent requests and issued no confirmations of receipt (Β§ 37 StPO).
Selected Statements from Sworn Affidavits
15.01.2025: The court clerk refused to accept the supplementary grounds β "on direct instructions from Ms Lukas and VRiLG GroΓ". Statement: "We will under no circumstances accept your complaint, whatever grounds you put forward."
24.02.2025: Double refusal after reading the content β immediate complaint and appeal. The detention facility officer present stated: "There is no point writing so much." He was clearly aware of the contents of documents subject to official secrecy.
18.03.2025: Triple refusal β supplementary grounds + criminal complaint against VRiLG GroΓ + complaint of violation of the right to be heard β all rejected simultaneously.
Hunger Strike from 05.05.2025
On 5 May 2025 Bagrash announced a hunger strike β as a last resort against the institutional blockade of his fundamental rights. The statement was sent to more than 40 recipients β including Federal President Steinmeier, members of the Bundestag and international human rights organisations.

Deportation attempt β part of the system of pressure
27 April 2026: the Berlin Immigration Office initiated expulsion proceedings based solely on the criminal conviction. Bagrash has been in Germany since 1992 (over 30 years), is a Jewish contingent refugee from the former USSR. Russian passport expired 16.05.2024. UnKremlin e.V. designated "undesirable organisation" in Russia since 01.09.2023 (Art. 284.1 CrimC RF: up to 4 years imprisonment).
